1 in 20 Texas families could be forced out of their homes

Gov. Rick Perry’s secret deal with Cintra, a spanish company, to build the Trans Texas Corridor (TTC), a $184 billion land grab just got sleazier. This is the deal that builds over 4,000 miles of toll roads and as federal documents state, nearly 1 million Texans are at risk of loosing thier homes, for TTC-35 alone.

Dallas news has 2 great reports on the dirty TTC dealings.

The first report focuses on the revolving door that keeps revolving. Dan Shelly, a Gov. Perry “right hand man”, now has state lobbying work worth between $550,000 and $1.1 million. As stated in the Dallas News:

Once again, Gov. Rick Perry's former liaison to the Legislature is working for the Spanish company that won the rights to develop the $7 billion Trans-Texas Corridor.

Lobbyist Dan Shelley worked for the firm as a consultant just before he went to the governor's office, a connection first revealed in 2004. State officials denied any connection between that circumstance and the decision, three months later, to award Cintra the huge highway contract. Now, Mr. Shelley has left the governor's office, and he and his daughter have large contracts to lobby for the road builder.

This week, Mr. Shelley had planned to take four state lawmakers – including two Dallas-area senators – on a four-day, all-expense-paid trip to Canada. But the trip was abruptly postponed after The Dallas Morning News asked questions about it.


The second great report from Dallas News talks about how Gov. Perry’s Century Council members have lucrative contracts to help build Perry's multibillion-dollar toll-road initiative. Here are a few exerts:

...donors who pledge to give at least $100,000 get invitations to private luncheons with the governor. And many are beneficiaries of government business, plum appointments and other state largesse.

Three Century Council members have lucrative contracts to help build Mr. Perry's multibillion-dollar toll-road initiative. The state has deposited millions in investment funds operated by three other top-tier givers. And 16 are Perry appointees to coveted boards, including the Parks and Wildlife Commission and state university regent boards.

"The kinds of people who step up to the plate to give this kind of money tend to be people who want something from government," said Andrew Wheat of Texans for Public Justice, a nonprofit group that tracks campaign contributions.

Three highway contractors benefiting from the Trans-Texas Corridor have been major Perry contributors since the late 1990s.

H.B. Zachry, whose San Antonio construction company is a partner in the project, began giving annual contributions of $10,000 after Mr. Perry was elected lieutenant governor in 1998. After Mr. Perry succeeded Mr. Bush as governor, the contributions grew to at least $25,000 a year.

Two other construction executives whose companies have state contracts as part of Mr. Perry's toll-road initiative – James Dannenbaum and James Pitcock, both of Houston – first gave $25,000 contributions to Mr. Perry when he was lieutenant governor.

The Texas Department of Transportation, which is overseen by Perry appointees, chooses the contractors.

I paid a double tax out at Lions Municipal Golf Course a couple of weeks ago.

My daughter will probably be hit with a double tax sometime this summer at Barton Springs.

And Travis County, if you can believe it, is levying a double tax on naked people.

This comes up in the context of toll roads and tireless toll road opponent Sal Costello, who has been inveighing for the past couple of years against what he and fellow travelers say is the double taxation of Austin-area highways. I get asked about this a lot. The general assumption seems to be that Costello is, at best, exaggerating.

Well, no, not really. We will be paying twice, to some degree, for some of the toll roads planned for Austin. But the real question is, as public policy, is that immoral or corrupt?

At the risk of making your head hurt, some quick review: There are four Austin-area toll roads under construction, all of them "traditional" toll roads. That is, they're cutting new paths rather overlaying existing roads and are funded mostly with borrowed money. So initially the tolls will be used to pay back the bonds, run toll operations and maintain the roads. However, the tolls are permanent, so someday most of the revenue will be profit and go to building other stuff.

Costello's main heartburn is with six other planned toll roads in Central Texas. Four of them will be expansions of existing roads, including two where construction is going on right now, paid for with 100 percent gas tax money. Two will be completely new roads, but one of those Texas 45 Southeast will be built with nothing but gas tax money.

To Costello and others, putting a toll on a road built purely with tax money is double taxation. However, he also considers it double taxation if you take an existing road like Ed Bluestein Boulevard which lies on right of way bought with tax money and then expand it and slap on tolls. You're taking a publicly purchased asset, the argument goes, and then charging people to use it.

But state Rep. Mike Krusee, the Williamson County Republican and toll advocate who's chairman of the House Transportation Committee, made an interesting point on a recent KLRU documentary about toll roads. He said, hey, it's not like we'll be paying the construction companies twice to build these roads. And he said that no one cries double taxation when they have to pay to swim in Zilker Park, site of an awful lot of public tax spending over the years.

The same logic applies to innumerable public assets, including city golf courses, the Erwin Center, parking meters and, while we're at it, Hippie Hollow, a Travis County park favored by skinny-dippers. The fees we pay for swimming, parking and golf are really just another form of taxes, and so are tolls. The city could jack up property taxes and eliminate fees at Barton Springs, but it won't. And the legislators could triple the gasoline tax and have fewer toll roads. But they won't.

There are equity and efficiency arguments to be made against toll roads, but they're hard to explain and sell. Double taxation is easier, catchy and just sounds wrong. But is it really?

Activist Groups Defend East Austin Residents from Toll Road Initiative

A group in East Austin is trying to put the brakes on toll roads in their area.

The Central Texas Regional Mobility Authority plans to install toll lanes on Highways 290, 183 and 71 in East Austin.

Two groups; People Organized in the Defense of the Earth and her Resources (PODER) and the League of Latin American Citizens (LULAC), are asking the Capital Area Metropolitan Planning Organization not to toll these roads.

The groups say they are unfairly bearing the toll burden, calling it economic racism.

"We see the lowest income people, basically on the east side of East Austin, are going to have to be paying money each time they get on freeways that are supposed to be free," says Poder Co-Director Susana Alamanza.

A spokesman with the Central Texas Regional Mobility Authority says drivers will not have to use the toll roads. They say there will be a free alternative.

Does it toll for me again?

Re: "Pact would clear the way for toll roads," Wednesday Metro.

This left one item unanswered: Who will pay for the roads?

Based on tolls collected, the Dallas North Tollway should have become a free road, with only the newest sections a "tollway." Instead, the entire length remains a "pay-for-use" road. The President George Bush Tollway apparently is subsidizing other roads, too.

I don't mind paying for what I use, but these tolls appear to be a "tax" going to other things than retiring these roads' debt. When did I get to vote on this tax?

The Trans-Texas Corridor meeting, held recently in Dallas, avoided discussing how tolls would be applied, except to say that it might take 20 to 50 years to complete the proposed corridor.

In that time, several roads would have been paid off, but it appears the "authority" is going to become another IRS and levy taxes without the Legislature voting to do so. This is not acceptable.

Six term Representative Joe Pickett (D-El Paso) has served on the House Transportation Committee and is currently the Chairman of the Regional Transportation Policy Board in El Paso. The following letter illustrates TxDOT commissioner Ted Houghton’s retaliation, abuse and blackmail threat tactics. This letter appeared in the Austin American-Statesman on 7/15/06.

On June 29, a group of elected officials from the El Paso area appeared before the Texas Transportation Commission to oppose the creation of a Regional Mobility Authority. Our regional Metropolitan Planning Organization voted against creating a toll authority.

The Congress member in our area opposes creating a mobility authority, as does the county judge-elect. Do you think the Texas Department of Transportation honored the decision of the local planning organization? No way. It is the state's way or the highway, I mean tollway.

It gets worse, 30 minutes after the vote was taken in El Paso against a mobility authority, a TxDOT commissioner called a road contractor and threatened to kill a pending project if they didn't get the mobility authority in line. Then TxDOT threatened the state of New Mexico by saying it would kill a joint railroad relocation study because some of our planning organization members who voted against the mobility authority are from New Mexico.

Ted Houghton and other commission members are further abusing their official capacity by preventing our political process to take place. The very process that allows for self-governance that allows the citizens and their representatives to debate public policy and reach informed decisions through consensus.

"TxDOT's understanding of the new CDA approach to road building is that local branches of government and the Legislature are no longer part of the process. According to the TxDOT view, once an agreement is made with a private partner, TxDOT and the provider alone are empowered to makes decisions concerning road alignments. This is a staggering change from the way we have historically made these decisions. These projects are too important to not allow the citizens to participate through their various voices in government. This is a fundamental issue of the separation of powers and checks and balances in the system. I have had the unique honor of serving the citizens of Fort Worth and Tarrant County as county judge, state senator and now mayor of Fort Worth. What I have learned through serving in these various capacities is that this fundamental issue of separation of powers should not so casually be cast aside. Every level of government has a unique perspective, which serves to express the complex voice of our citizenry."

Cameras will cause wrecks

Regarding the proposed cameras at traffic lights, I expect officials to use the ever-reliable safety angle to justify their new toy for revenue-raising. But in this case, the fix likely will cause more accidents than it will prevent. Since the duration of the yellow light varies, a driver will too often slam on the brakes at first glimpse to avoid a fine. This will cause the trailing vehicle to reduce the braking vehicle's trunk to roughly an eighth of its original size.

A toll for intersections

Stand up, Austin. Our beloved City Council is hard at work attempting to force traffic enforcement cameras upon the hardworking citizens of our fair city. Under the guise of "public safety," they will quote statistics, from unknown sources, extolling the virtues of traffic cameras.

Think of it. Private companies will be bidding for a low cost/high gain contract with a municipality — one in which cameras click away 24/7, 365 days a year at every major intersection in the city.

Need more revenue? Add more cameras — at first, just for running red lights. Later, after the appropriate campaign contributions, equipment will be added to catch speeders. Why not?

Much like toll roads, the cameras will never go away. Call and write your council members and suggest they put traffic cameras in their own neighborhoods. I will be glad to bid for the contract and mail them their fines.

ROUND ROCK Transportation consultant quits Mike Weaver, a transportation consultant with Prime Strategies who has served as interim executive director for the Central Texas Regional Mobility Authority, resigned that position this week. Weaver's resignation on Monday, for unspecified personal reasons, occurred just over a week before the transportation agency is scheduled to name its first full-time executive director. Lawyer Brian Cassidy of Locke, Liddell & Sapp, the authority's counsel, probably will replace Weaver until the executive director can begin work.

Thompson, who owned interest in Texas Culvert Steel, sent out a letter many months ago, about his push for the water collection system

Dear Fellow West Lake Hills Property Owner:

As you probably are aware, West Lake Hills has entered into the sewer business. We have initiated service to a small number of residents and businesses who were previously City of Austin wastewater customers. Once the construction of our collection system is complete, we will become the retail wastewater utility provider to various residential and commercial portions of our City. The LCRA will construct, operate and maintain the collection system that will serve our customers; Austin will treat our wastewater.

In accordance with Austin City Council Resolution 990506-74, residential wastewater service is available only for those residents whose homes are located on lots with an area of 3⁄4 acre or less (less than 0.75 acre or 32,670 square feet). In exceptional circumstances and on a case by case basis, service may be extended to residential lots of greater than 3⁄4 acre with the permission of the Director of the City of Austin Water and Wastewater Department. Please contact the City Staff for further information concerning exceptions.

Enclosed you will find a one-page form to complete and return if you are interested in becoming a customer of our wastewater system. Once construction is complete but before initiating service, we will ask our
customers to sign a service agreement and pay an application fee ($30.00), a utility deposit ($50.00), an inspection/tap fee ($200.00), and a system fee. The system fee will be $2,000 for those who sign up for wastewater service by December 31, 2001. Beginning January 1, 2002, this fee will increase by $1,000 for each 12-month period thereafter until reaching a maximum of $5,000. If you desire, you may enclose a check made out to "The City of West Lake Hills" for all or part of these fees when you return your service request form.

When returning the form, we ask also that our potential customers include (if available) a copy of the title survey for their property and any
pertinent information regarding their septic tank and drain field (e.g. size, location). This information will help expedite the design and construction of system facilities and lines that will be built on our customers' property.

We also have included a timetable for construction of the collection system prepared by PBS&J, the consulting engineers for the project. This
schedule is the most current estimate for construction completion/service availability for the various phases of the project. We will notify you promptly of any significant changes to this timetable.

The LCRA, your City Council and I are committed to providing quality wastewater service to our West Lake Hills customers. We are excited about our new opportunity and, as always, welcome your input and questions. I'm honored to be your mayor and look forward to seeing you soon.
